What is the Clerk of Circuit Court?

The Clerk of Circuit Court is a Constitutional Officer elected to an eight-year term by the voters of the locality. That’s right, YOU, the voters have the power to decide who will represent you as your Clerk of Circuit Court! The Clerk is a management position and handles administrative matters for the court. The Clerk is NOT a legal assistant and does not offer legal advice.


The Clerk’s Office is the custodian of the court’s records and is responsible for more than 800 duties listed in the Code of Virginia.


The Clerk’s Office

  • Is PROHIBITED by law from rendering legal advice in accordance to § 2.2-3704.3

  • Administers Oaths of Office

  • Probates Wills

  • Grants Administration of Estates

  • Offers Notary Services

  • Records Deeds

  • Issues Marriage Licenses

  • Processes Concealed Weapon Permits

  • Files Adoption Petitions

  • Records Business Names

  • Records Military Discharge Forms (DD214)

The Circuit Court

  • Has authority to hear felonies

  • Hears appeals from General District Court and Juvenile Domestic Relations Court

  • Handles Civil Claims over $4,500 but not exceeding $25,000 in conjunction with the General District Court.

  • Schedules Court Docket (Case Schedules)

  • Prepares Court Orders and Jury Lists



The Clerk of Court must possess strong oral and written skills; management or supervisory experience; excellent project management skills; knowledge of management practices and administrative processes; and the ability to exercise mature yet fair judgment. As part of the Circuit Court Team, the Clerk of Court must work well with others in a team-oriented environment. Since the clerk balances a number of priorities, strong organizational, prioritizing and problem-solving skills are critical. Integrity and care for all citizens is of utmost importance as the Clerk is responsible for servicing all of its’ customers and staff without personal or professional biases.



The Clerk of Court is responsible for administration and supervision of the day-to-day operations of the Clerk’s Office. Clerks are also responsible for budget and fiscal management, technology, and supervising department staff.
